功能理论在商务合同翻译中的运用(英文)

Abstract: This paper attempts to disscuss the strategies of business contracts’ translation from the aspects of German functionalism, and find suitable translation methods to the business contracts’ translation. This paper is very useful to business contracts’ translators.
This paper is composed of three chapters. Chapter one serves as a general introduction to contract documents. Definition, classification, content，language features and function of contact’s translation. Chapter Two explains the background of German functionalism, the main thought of the representatives. Chapter Three is a comprehensive part. In this part, the author tries to discuss various methods of translating contract documents according to the theory of functionalism.
In summary, this is a research on the contract document translation guided by the theory of functionalism. The present author believes that a good translation of contract documents should maintain the linguistic characteristics and have the same function of the original text.

摘  要：本文从德国功能理论的角度对商务合同翻译策略进行了探讨，得出了合适的商务合同翻译方法，对商务合同翻译者有一定的指导意义。
    本文共分为三章，分别对国际商务合同、功能翻译理论进行了介绍、分析并指出了在功能翻译理论指导下国际商务合同翻译中所应采取的基本策略。第一章介绍了国际商务合同。阐述了国际商务合同的定义、分类、内容、语言特点及翻译英语合同的意义。第二章主要阐述了德国功能翻译理论的起源、代表人物 、主要观点和对商务合同翻译的意义。第三章以翻译目的决定翻译方法为原则，通过大量的实例，结合商务合同文本的语言特点，分析指出商务合同翻译是有目的选择过程，商务合同翻译应采取以目的文本为导向的基本策略。
    总之，作者试图根据功能翻译理论，对商务合同文本的翻译进行较为全面的探讨。商务合同的内容形形色色，范围很广，但都有一个基本特点就是行文严谨，内容明确，也就是说商务合同的翻译本身就是一种目的性很强的行为，翻译商务合同应该保持其语言功能和语言特点。

Introduction
With China’s entry into the WTO and the trend of globalization, Chinese business has been undergoing ever-frequent exchanges with the outside world. Business contract translation, as a form of practical translation once neglected by Chinese translators in their translation studies, has been paid more and more attention to for the last decade. A well-translated contract document conduces to the smooth performance of a business, while a poor one often results in costly failure. Carrying on studies in this field can lead to people’s recognition of the importance of business contract translation and thus help to improve competitiveness of Chinese products in the international market.
Considering the frequency and range of the application of contract documents, the present author considers it an urgent task confronting us to conduct a further research on the translational method of contract documents.
    The translation of contract documents is a purposeful act in itself. According to functionalism, translating is a purposeful activity. That is why the present author takes functionalism as the theoretical ground for analyzing the various methods of translation of contract documents.
In this paper, the author tries to make a study on the methods of translating contract documents and demonstrate that the means of translation can only be justified by the end. In other words, a good translation in the target language has the same function and linguistic characteristics as the original in the source language.

1  Overview of business contract
It was stressed at the beginning of the thesis that we are in an age of g1obalization when businesses around the world spare no effort to market their products and services into the world marketplace. If a company is to make a successful move into a foreign market it is essential for it to translate all the relevant documents into the target language，including the contract documents. It is important to ensure that the translated col1tract documents are not on1y linguistically accurate，but also in conformity with the source text. This paper，therefore does not discuss how to development new international business，but focuses on the translation of  contract documents，since the undergoing process of g1obalization has presented contract document translation as a significant research topic. In this chapter, definition, classification，contents and some language features of contract，as well as the functions of business contracts translation will be discussed
1.1 Contract
