Conclusion
It is a repeatedly stressed point in this paper that legal English, as the high representation of authority of country, once it is misunderstood by readers, it would bring many unnecessary losses to their legal-about movements.
Legal English has the unique stylistic features-accuracy and precision which takes a predominant position. Strings of synonymous words, lexical repetition and long sentences contribute at different levels to the effect of accuracy and precision. On the other hand, archaic words, loan words and technical terms employed in large numbers in legal English display another striking stylistic feature—formality and dignity. Apart from the two features, conservatism and stability is a particularly unique characteristic of legal English.
The authority and precision of a law set a high requirement for legal translation. To achieve the desired result, it is of utmost importance to translate a legal document accurately and faithfully. However, this is not the end of a high quality translation. In translation, it is far from enough to simply convey the original sense; rather, translation must be adapted to the original in terms of language type and general effect. Hence, on the basis of faithfulness and accuracy, a translator should also spare no pains to meet the other criterion, that is, expressiveness and smoothness. Worthy of mention is that when the two criteria for legal translation contradict with each other, faithfulness and accuracy should have the upper hand. This can be explained by the facts that a contract exerts a direct influence on the fulfillment of obligations and the exercise of rights by the parties concerned and that any slight discrepancy in expression is very likely to be exploited by ill-intentioned parties and thus incurs severe consequences.
Nevertheless, with inadequate insight and limited capability on the part of the author on one hand and the dynamic development of language and culture on the other hand, the chances of exhausting the topic are very slim. Moreover, some erroneous statements or inappropriate expressions may occur beyond the author’s recognition. For this, forgiveness and suggestions are cordially requested.
