法律英语的文体特征及其翻译(英文)

Abstract: This paper attempts to discuss legal English translation from the aspect of English stylistics by meticulously selecting many fresh examples. The author puts forwards analysis of stylistic characteristics of legal English. It puts forwards some ways of translating legal English. The research is of great significance to improve translation of legal English.

摘  要：本文试从英语文体学方面，通过严密的论证来分析法律英语翻译。作者通过分析法律英语的文体特征，提出一些方法用于法律英语的翻译。这对推进法律英语翻译的发展有显著的促进作用。

Introduction
With the frequent communication among countries in business politics and civilization, the world is getting smaller and smaller. After China’s joint to WTO, China has become the most energic and potential country of the world. A large amount of foreign companies pour into China to develop their business. They need to be familiar with China’s law and ordinance, or else, they would have lots of problems to handle without acquaintance with law and ordinance. China also has a necessity to know well about laws of WTO and other countries to accommodate the competition of economic globalization. Therefore legal translation and the research of legal English are important now. The aim of this article is how to translate legal English in a proper way.
After an intensive study of such books and articles, the author finds that a great number of articles only center on the linguistic features of legal language while a majority of books focus on English-Chinese translation of legal English with no detailed generalization and summarization of translation techniques. In view of this, the author attempts to approach translation of legal documents from the perspective of stylistics, that is, techniques for the translation of legal English will be elaborated with typical exemplary sentences on the basis of an analysis of the stylistic features of legal English.

1  A brief introduction of stylistics
Here, we’ll give a brief introduction of stylistics.
1.1 Definition and aim of stylistics
Stylistics is a branch of linguistics which applies the theory and methodology of modern linguistics to the study of style which refers to the characteristic variation in language use [1].
The eventual aim of stylistics is to provide a methodology of analysis to develop a general capacity of using language for communication, a clear technique of description which, ideally, will allow any persons to cope with any text they want to study, a procedure that can ensure that no items of stylistic significance is overlooked.
1.2 Need for Stylistics Study
Stylistics---the study of style---may help us to develop a consistent method of language analysis and solve problems of interpretation by bringing into focus the stylistically significant features that we might otherwise overlook.
Stylistics may help us to acquire a “sense of style”. We have already learned that the key to effective communication is the ability to use language appropriately [2]. By this, we can cultivate a sense of appropriateness.
