从反倾销中的非市场经济国家问题看我国市场经济地位如何取得

　　2002年，俄罗斯的市场经济地位得到了美国的认可。[25]虽然从表面上来看，只是按照美国的法律给予了俄罗斯是否是市场经济的认定，但是明眼人一眼就能看出，市场经济地位的认可总是和一些其他的东西相关联在一起的。[26]

　　我们的政府和企业也应该通过各种渠道去争取早日获得市场经济的地位。[27]

　　我们有理由相信，只要能够做到以上内容，中国的企业和中国是能够获得市场经济地位的，即使没有能完全获得市场经济地位的认可，那么反倾销问题使中国政府带来的变化，也将会使中国企业受益无穷。

    [1] 在很多国家和地区，反倾销和保障措施在一定程度上已成为贸易保护主义的工具。目前，全球范围内的反倾销调查正在呈增长的趋势，2001年WTO成员共提起反倾销、反补贴和保障措施调查428起，比2000年增长46%.但值得我们注意的是，国外对我们的反倾销带有极大的歧视性。从1979年我国出口的糖精钠在欧盟被反倾销起，截止到今年4月，已有32个国家和地区对我国出口产品发起反倾销和保障措施调查494起，涉及4000多种商品，影响我国出口贸易额150多亿美元。参见《专家称未来针对中国的反倾销案件数量仍可能居高不下》

　　[2] 2002年，在全球发起的276起反倾销新立案件中，有47起是针对中国的。该数字虽然比2001年的53起减少了6起，但从结构上分析，其他世贸组织成员对中国产品的关注程度进一步提高了。2001年，中国遭国外反倾销立案调查的数量占当年全部案件的15%，2002年则升至17%.2002年，国外针对中国产品采取的最终反倾销措施的案件为36起，也列全球之首，且比2001年的30起有所增加。参见《2002年全球反倾销案件综述》

　　[3] If a company exports a product at a price lower than the price it normally charges on its own home market， it is said to be “dumping” the product. If a country was regarded as having non-market economy， the price that is normally charged in its own home market will be disregarded； a reference country will be selected. Thus the normal value will definitely increase. For example， the European Union used Singapore as a reference country in conducting antidumping investigation of China‘s exported color TVs. But the cost of manpower in Singapore was 20 times high that that of China. From 28 April 1998， the European Union no longer treats China as non-market economy. This， however， does not indicate that other country will not treats China as market economy countries. For examples， after 1996， Australia saw China as a country with “transitional economy”。 In line with the Australia Custom Law that was effective on 1 July 1999， the Australia government can again treat China as a country with non-market economy. Recently， Indian government amended it antidumping law and put forward a concept of non-market economy. China was among the list of non-market economy. On textiles， Washington says Beijing must agree to be bound by U.S. quotas until 2010 - five years longer than is legal for existing WTO members.
